Property Lease Contract
A contract where the lessor grants the lessee the right to use or benefit from property for a specified period, in exchange for rent, without transferring ownership.
Hire-Purchase Contract
A contract where the owner lets out property on hire and promises to sell or transfer ownership to the hirer upon full payment of agreed installments and fulfillment of contract conditions.
Purpose of Property Lease Contract
To use or benefit from property without aiming to transfer ownership to the lessee.
Purpose of Hire-Purchase Contract
To use property with the intention of acquiring ownership later upon full compliance with all contract conditions.
Ownership in Property Lease Contract
The lessor remains the owner of the property at all times, and leasing does not transfer ownership to the lessee.
Ownership in Hire-Purchase Contract
The lessor remains the owner until the specified conditions of the contract are met, after which ownership transfers to the hire-purchaser.
Payment Structure of Property Lease
The lessee pays rent according to the agreed time period and amount.
Payment Structure of Hire-Purchase
The hire-purchaser pays installment payments in periods as specified in the contract.
Format Requirement for Immovable Property Lease Exceeding 3 Years
Must be made in writing and registered with a competent officer (if not exceeding 3 years, writing is generally not enforced).
Format Requirement for Hire-Purchase Contract
Must be made in writing, otherwise the contract is void.
End of Contract in Property Lease
The lessee generally must return the property to the lessor, unless agreed otherwise or specified by law.
End of Contract in Hire-Purchase
If payments are completed according to conditions, the hire-purchaser acquires ownership of the property and does not need to return it.
Default and Termination in Property Lease
Follows the conditions specified in the contract and the legal provisions governing property leases.
Default and Termination in Hire-Purchase
The hire-purchaser has the right to terminate by delivering the property back, and the lessor may terminate if the hire-purchaser defaults according to legal criteria.
Example Case: Ms. A (House Lease)
Ms. A rents a house for 8,000 Baht per month for 1 year for residence; when the period expires, she must return the house to the owner because she did not buy it.
Example Case: Mr. B (Motorcycle Hire-Purchase)
Mr. B hire-purchases a motorcycle by paying 3,000 Baht per month for 36 installments; upon full payment according to conditions, ownership of the motorcycle transfers to him.
Summary Flow of Property Lease vs. Hire-Purchase
Property Lease means lease to use (pay rent -> use property -> return property when contract ends). Hire-Purchase means lease to use and aim to become owner (pay installments -> use property -> complete conditions -> obtain ownership).
