McCulloh V. Maryland
Article 1 supermacy clayse. Maryland was trying to tax the bank of the us. The court ruled rhat states cannot tax the governemnt. It increased federal power and it affirmed the supermacy of fed gov over state.
U.S v Lopez
Article 1 Commerce Clause. Enummarted powers (powers the constituion says congress has). Congress can regulate interstate commerce. It reduces the power of congress under commerce clause. Gun free school zones act doesn’t have anything to do with interstate commerce
Baker V Carr
14th amendment equal protection clause. Came before shaw v reno. Tennesse hadn’t redistricted in 60+ years so people in rural districts had more voting powers than urban people. The courts can now rule on gerrymandering now (justicable).
Shaw V Reno
14th equal protection clause. District in NC drawn to create minority representation while voting. Race can be a factor but not the only factor. NC violated that
Mabury V Madison
Article 3 Judical Review. An implied power. Judgeships got left on Thomas Jeffersons desk and he woudn’t issue them. John Marshall gave SCOTUS the power of judicial review.
Engle v Vitale
1st amendment establishment clause. Staff lead prayer in a NY school violates the 1st amendment establishment clause. Gives state and religon more seperation.
Wisconsin V Yoder
1st amendment free excerise clause. The amish wanted to poll their kids out of school after 8th grade but the schools tried to convictite the parents for taking them out before 16. The courts rules that the school violated the amish religon.
Tinker V Des Moines
1st amendment freedom of speech symbolic speech. Kids in school wanted to wear black arm bands to protest the war “symbolic speech’” The school tried to suspend them. The court ruled you don’t lose your free speech at the school gate. Wearing the arm bands are symbolic and don’t cause a disruption.
Schenk V United States
1st amendment Free Speech. A man was arrested for handing out pamphelts that resisted people from getting drafted. He was arrested under the espionage act. The case limited free speech and intruduced the clear and present danger test.
NYT v U.S
1st amendment freedom of speech. The pentagon papers had gotten leaked and the NYT wanted to publish them and the Nixon admin didn”t want them posted for safety. Sides w/ NYT and introduced prior restraint
Mcdonald V Chicago
14th amendment due process clause. Residents felt a new gun law violated their 2nd amendment right. States can’t deny individuals the right to bear arms for self defense. The 14th amendment due process made the 2nd amendment applicable to state and local governments.
Gideon V Wainwright
6th amendment right to consuel. A poor man was denied a lawyer (court appointed). The court ruled all criminal defendants no matter their ability tompay are entitiled to legal consuel in state and federal courts
Brown V Board of Education
14th amendment equal protection clause. Not allowing desegregation in school violates the 14th amendment equal protection clause and that sepreate but equal was actually unequal.
Citizens United v FEC
1st amendment free speech. The court ruled that political spending by coorparations, assoctions, and labor unions is a form of protected speech. It has pead to the risw of super PAC’s.
