What are the arguments for the law DOES discriminate against the W/C?
Marxism- The law and legal systems are instruments of ruling-class power used to oppress the working class and protect working-class power. Interactionalism- the law is not applied neutrally Neo-marxism- Neo-Marxists argue the CJS uses racial discrimination to serve capitalist ideology and control minority populations. Neo marxism- w/c crime is a form of political protest
What are the arguments for the law DOES NOT discriminate against the W/C?
Right realism- The law is objective, and higher working-class involvement in the legal system reflects actual criminal behaviour, not institutional discrimination. Not as much as ethnic minorities- Statistics show the legal system disproportionately targets and criminalises young Black men, regardless of class. Functionalism- There is more crime comitted by w/c individuals due to strain between cultural goals and means of getting there
