What is your current occupation?
I have been a professor at the University of Arizona’s James E. Rogers College of Law for over a decade where I specialize in 4th Amendment rights and educate my students on search and seizure laws.
Please Describe your educational Background.
I hold my J.D. degree from IU Bloomington and a Ph.D. in Constitutional Studies from Harvard.
What, if any formal training do you have in your field?
On top of my extensive educational background, I regularly attend legal seminars and debates as well as collaborate with top end legal professionals.
How long have you worked in this profession?
I have been actively involved for over a decade.
What if any credentials do you have in your field?
I have my J.D. degree, and my Ph.D. in Constitutional Studies in addition I am certified as a legal consultant for the educational field.
How many times, if any, have you previously testified in court as an expert witness?
I have testified more times than I can count on my two hands. This being on both sides of cases as I believe in justice and doing my due diligence as a 4th amendment expert to uphold the standards listed in The Constitution.
Where does your line of work connect to the 4th amendment specifically?
At UA I have been a Law Education and Constitutional Law teacher for the majority of my career. I also started a program at the school known as the SSSPP.
What is the SSSPP?
The SSSPP is the Student Search and Seizure Protection Program. This is where my committee and I educate students during lunches (not just at AU) about the importance of the 4th amendment and understanding everyone’s rights.
What, if anything, have you created to document your experience?
I have created a curriculum vitae which I update regularly.
In your expert opinion, what previous legal precedent has been set that applies to today’s case?
In the case of New Jersey v T.L.O. the search conducted was reasonable because it was based on specific information from a student and not just random. In addition, the case of Veronia School District v. Acton schools has the duty to protect students and can conduct searches to prevent a potential threat to student safety.
In your expert opinion, is upholding the dignity of a student a requirement before conducting a search of their belongings and or person?
Its indignity does not outlaw the search, but it does implicate the rule that “the search [be] ‘reasonably related in scope to the circumstances which justified the interference in the first place.’
Using your expertise and understanding of the 4th amendment did Safford United School District follow the Fourth amendment standards when conducting the search of Savana Redding on October 8th 2003?
Yes, as the search was conducted in a respectful manner to protect student privacy and safety in addition to being based on reasonable suspicion.
