JUST CAUSES

Just causes under the Labor Code

Grounds for termination by the employer, including serious misconduct, gross neglect of duties, fraud, commission of a crime against the employer, and analogous causes.

Prohibited activities

Termination of union officers and members who knowingly participate in an illegal strike or commit illegal acts during a strike.

National interest cases

Disciplinary action, including dismissal, for strikers who violate orders, prohibitions, or injunctions issued by the DOLE Secretary or the NLRC.

Union security clause

Termination of employment for violation of the union security agreement in the CBA, such as failure to join or maintain membership in the union, or organizing a rival union.
