Required Elements for Compensable Injury
An injury must be accidental, arise out of employment, and occur in the course of employment to be compensable.

Injury would not have occurred but for the employment
Specific Occupational Diseases
Ex.) Black Lung, Asbestosis, Silicosis — coal worker’s pneumoconiosis complicated with progressive massive fibrosis.

Ex.) Hernias from Lifting Heavy Objects
Mental Injuries
Mental Injuries substantially caused by work related factors and greater than typical work stress qualify. Coverage varies by state, especially for mental-mental injuries.
