The executive branch has traditionally had authority over the bureaucracy, but the legislative and judicial branches also have some responsibility in overseeing its activities.

The relationship can (and should) be mutually between Congress and bureaucrats. Congress gets information for it to make laws while getting people to execute the policies it enacts. Bureaucrats also need Congress to survive, in the form of legal justification and especially funding. Thus, federal bureaucrats prosper by convincing Congress they are good faith agents and by articulating their mission in politically popular ways.

Both are means by which Congress uses its oversight power to ensure that its desires, as principles, are being carried out by its agents in the bureaucracy by publicizing malfeasance and failure and thus holding the bureaucracy publicly and congressionally accountable. They differ in the severity and regularity of the oversight. Police patrol oversight is more regular and designed to prevent bureaucratic malfeasance. Fire alarm oversight responds to emergencies created by bureaucratic wrongdoing or errors.

Red tape is important because it helps principals control agents, helping solve the principal-agent problem. Policies, procedures, and forms provide a figurative paper trail through which bureaucrats (agents) can be held accountable by principals, be they members of the public, members of Congress, or their bureaucratic superiors. Red tape can be used to help evaluate the effectiveness of programs and agents while also providing a roadmap for how these programs developed.
