Who did what to whom

  • During the Great Depression, Franklin D. Roosevelt and Congress created the National Industrial Recovery Act (NIRA), which in this case, regulated the poultry industry in NY; Schechter corp. was accused of selling a sick chicken and the fed gov prosecuted them; Schechter argued that the fed gov didn’t have the authority to regulate their corp.

structuralism argument

In the Live Poultry Code Congress effectively let the President make the law, not just enforce it. Legislative Vesting Clause Article 1 Sec. 1 says enforces the idea that congress makes the rules and the president enforces them.
