Enabling Statutes
Statutes that create an agency or give an agency explicit authority to implement a statute.
Administrative Procedure Act (APA)
A federal statute that imposes specific procedural requirements on administrative agencies’ various functions.
Legislative Rules
Agency rules that have legal effect and impact the rights of parties and can only be created if authorized to do so by statute.
Nonlegislative Rules
Rules that express an agency’s interpretation of a statute or describe the agency’s policy views, not legally binding on parties.
Administrative law judge (ALJ)
An attorney employed by the agency to adjudicate disputes.
Judicial Review
The authority of courts to review the actions of administrative agencies to ensure compliance with the Constitution.
Chevron Test
A legal standard used in judicial review to determine whether an agency's interpretation of a statute is lawful.
Public Accountability
Safeguards established to make administrative agencies accountable to the public and to ensure transparency.
Citizen Suits
Lawsuits that allow any affected member of the public to challenge agency actions or inaction.
Freedom of Information Act (FOIA)
A federal law that gives the public the right to examine many government documents.
