Actual or Compensatory Damages

Adequate compensation only for pecuniary loss suffered

Special Damages

Natural but not necessarily aconsequence of the accident in question

Per diem method

Estimated value of pain and suffering per day times the number of days the victim will suffer

Golden Rule method

Call on the judge to determine how much the damages will be

Exemplary or Corrective Damages

Awarded as punishment or deterrence

Simple Imprudence

Lack of precaution displayed; Damage impending to be caused is not immediate nor the danger clearly manifest

Reckless Imprudence

Voluntarily, but without malice, doing or failing to do an act from which material damage results

Nominal Damages

Trifling sum awarded to the plaintiff in an action where there is no substantial loss or injury to be compensated

Liquidated Damages

Those agreed by the parties to a contract, to be paid in case of breach thereof

Temperate or Moderate Damages

Pecuniary loss hasbeen suffered but its amount cannot be proved with certainty
