For example, an offer might be a proposal to sell a car for $5,000, acceptance would be agreeing to the terms, consideration would be the $5,000 and the car itself, mutual assent would be both parties agreeing to the contract terms, capacity means both parties are of sound mind and legal age, and legality means the contract terms are legal.
Free Response: Explain the concept of genuine assent and discuss how mistakes, misrepresentation, undue influence, and duress can impact the enforceability of a contract.
Genuine assent means that all parties to a contract agree to the terms freely and voluntarily. Mistakes can make a contract voidable if both parties are mistaken about a material fact. Misrepresentation involves providing false information that induces someone to enter into a contract, making it voidable. Undue influence occurs when one party unfairly influences another, typically through a position of power or trust, to enter into a contract. Duress involves threats or pressure that force someone into a contract against their will. All these factors can impact whether a contract is considered enforceable.
