What is PHIPA?

PHIPA = Personal health Information Protection Act 

  • start in 2004 → regulates collection, disclosure/use of PHI (personal health info)

  • PHIPA apply 2 → HICC (Health Info. Custodians) = Hospital, pharma, doctor, dental clinic → or Agents (nurse in hospital, receptionist @ clinc) → External agencies w. contracts (cleaning company)

  • PHIPA principles = patient access PHI or withdraw consent (LOCKBOX) → Circle of care (HC team) → need 2 know → Sharing without consent → consent sharing, express vs Implied consent 

  • express consent = written/verbal → outside of circle of care → not healthcare related → Ex. to a family member/friend 

  • implied consent = based on → patient action/inaction, inside of healthcare → Ex. to a hospital, pharmacy

  • PHI (personal health info) = Info on → phsy/mental health, test results, provider identity/service, identi. of SDM ( sub decision maker), health card/payments
