Pre Litigation

Involves investigating the facts, collecting documents, communicating with clients, and attempting to resolve disputes before filing suit

  • Complaint is filed stating who is suing, who is being sued, what happened, and what damages are sought 

  • Summons is sent notifying the defendant they’re being sued

  • Service of process is also set to the defendant, so they receive the lawsuit

  • Answer given by the defendant responding to the allegations

    • Requests for Admission - statements the other side must admit or deny

    • Depositions - witnesses answer questions under oath before trial
