I have been riding a motorcycle since I was 20 years old. Riding has been a major recreational interest of mine since I was young
Ms Kim, could you please say how long have you been riding a motorcycle?
I don’t remember much of what happened on that day. I remember riding up Pacific Highway, and then waking up at North Shore Hospital.
Could you recount what was happening prior to the accident?
I think I was travelling between 70km/hr and 80km/hr. I know that the speed limit on that part of Pacific Highway is 60km/hr, but all vehicles around me were travelling at the same speed as me. In those situations, I believe that you should keep up with the cars around so that you aren’t a hazard on the road.
What were the road conditions like on the day?
The Defendant was in front of me in the car.
Where was the defendant at this point in time?
I am pretty sure that the Defendant was indicating right. I remember thinking that it would be a hazard as the Defendant would have had to turn right across incoming traffic in order to make the turn safely. I think I was about 20m away from the Defendant at the time.
What was the defendant doing
I made the decision to overtake the Defendant on the left, as they were indicating right. I attempted to overtake the Defendant’s car, which was slowing down, by moving to the far left of the lane, close to the footpath, and speeding up.
Ms Kim, when did you approach the defendant.
As I neared the Defendant’s car, the Defendant suddenly stopped and turned left. I could not brake my motorcycle in time and I remember feeling an impact as I hit the side of the car. I do not remember anything else.
Could you give us details as to the collision
When I ride, I always try and assess the intentions of any driver in front of me. Only then do I make a decision as to whether or not I overtake. If a vehicle is travelling with its right indicator on, it is definitely not safe to overtake.
can you describe your typical driving habits?
I know the part of the highway where the accident occurred. I ride there almost every day.
have you ridden on that road before?
The road is well-marked and paved, with no potholes. There is only one lane going north, and one land going south, divided by a double-line. There are plenty of signs on that section of the highway, including speed signs and standard signs warning that vehicles may exit from concealed driveways.
