Health insurance portability and accountability act. Do not disclose notes for any purpose. Including records to insurance companies for reimbursement. Authorization/consent needs to be given by the client in writting.

Instances where we can break confidentiality
Client is a danger to themself (Client’s safety). Danger to others by making homicidal threats or serious violence towards identifiable victim (Duty to warn). If suspected child or elderly abuse. Client signs release to to speak to another regarding treatment. Being sued for malpractice to protect yourself. Court order. Reporting info to collections.
Instances where we UPHOLD confidentiality
Domestic violence, death of a client, HIV positive clients, subpoenas,
Release of recods
Every entity you need information from will need an ROI on fie. Client consent is needed for a release of records. Client does not own their records but can request at any point. If records will harm the client you can deny them but must document well why the request was denied. Parent/guardian who initiated services for minor will have access. Important to let the minor know what information will have to be disclosed.
conflict of interest
When a social workers personal, professional or financial interest interfere with professional judgment, objectivity or ability to act in the best interest of their client. Compromises quality of care. alert and avoid conflict.
dual relationships
engaging in a relationship with a a client outside the professional context. Such as being friends, family members, or romantic relationships. Ethically obligated to maintain clear professional boundaries
financial conflicts
financial ties with to a client or service provider such as accepting gifts, favors or business transactions.
personal biases
allowing personal beliefs values or prejudice to affect treatment. Seek supervision
multiple clients
representing or providing services to clients with conflict interest such as seeing multiple family members and being able to stay impartial.
Termination
advance notice, services should be terminated when the relationship is no longer needed or serves the client’s interest, avoid abandoning client. Termination should not happen if they are a danger to themselves or other, consequences of no payment can also occurs. DO not terminate to pursue relationship with clients. Write termination plan or note. rule of them 3 referrals are given. We can’t determine if the client will follow-up.
