Intentional Harm

An actor is liable for physical or emotional harm if:

a.) The person acts with purpose of producing the consequence; OR

b.) The person acts knowing the consequence is substantially certain to result

Prima Facie

Elements of cause of action that must be sufficiently supported with evidence to justify a verdict in plaintiff's favor

Single Intent

Actor intended the contact but did not need to intend that it was harmfull

Dual Intent

Actor intended the contact AND intended the harm

Transferred Intent

If an act is done with the intention off affecting a third person, but causes harmful contact to another, actor is liable as if fully intending to harm third party

Battery

a.) Intent to contact; AND

b.) Offensive contact directly results

Assault

a.) Intent to cause harmful or offensive contact; AND

b.) Contact causes imminent apprehension or fear of harm

Offensive Contact

Bodily contact that offends reasonable sense of personal dignity

False Imprisonment

a.) Actor intends to confine another within fixed boundaries; AND

b.) One’s act directly or indirectly results in such confinement of another; AND

c.) The other is conscious of the confinement or is harmed by it
