Fairness and Equity
Point: One advantage of using juries is that they don’t have to use precedent which can lead to independence
Evidence: In Pointing’s Case, the jury ruled based on their opinions of fairness than legal legitimacy
Explain: This means that the jury is more independent of the judge and not subject to their possible partiality
Secrecy of the jury room
Point: One advantage is that the jury room is secret ensuring that there is no room for deception
Evidence: It is an offence to intentionally disclose or solicit any statements made outside of the room
Explain: This ensures proper commencement of the trial and the right to a fair trial
Representative of society
Point: One advantage is that they are representative of society allowing for diverse opinions in deliberation
Evidence: Jurors are selected randomly and not exclusive to legal personnel
Explain: this diverse view of opinions, not necessarily legal personnel, allows for conversing views and a more viable consensus
Impartiality
Point: One advantage is that juries are impartial to the defendant or prosecutor allowing for a more legally inclined outcome
Evidence: Jurors who have affiliation to either defendant or claimant, they are not allowed to formally be a juror for that trial
Explain: This stops cycles of infidelity in juries and stops lying.
