Carnal Knowledge
Any penetration of the vulva, even the slightest, must be proven for rape.
Hate Crime
A regular crime plus a bias motivation against a protected group.
Force in Rape
Force or threat of force that compels submission or causes fear.
MPC Sexual Contact
Any touching of sexual/intimate parts for the purpose of sexual arousal or gratification.
Rape Shield Exceptions
(1) Source of semen, (2) prior sexual history affecting credibility, (3) constitutional necessity for defense.
Burning (Arson)
Any actual burning/charing of structure material, even minimal.
Malicious Mischief
Damage or destruction of property.
Larceny
Taking property with the intent to permanently steal it.
Modern Arson Degrees
Factors that determine degrees include occupancy, intent, type of property, and risk to human life.
Entry in Burglary
Any slight insertion of body part or instrument into the structure after breaking.
Intent in Burglary
Intent to commit felony must exist at the moment of entry or breaking.
Criminal Trespass
Knowingly entering or staying on property without consent, with notice that entry was forbidden.
Robbery
Theft from person or presence with force or threat of force.
Force or Intimidation in Robbery
Any force or fear sufficient to take property, including slight force or threats.
Involuntary Manslaughter
Gross negligence, a misdemeanor, or duty breach that leads to death.
Negligent Homicide
Criminal negligence only, lower level than involuntary manslaughter.
Kidnapping
Restraint plus movement (asportation).
False Imprisonment
Restraint only without movement.
Voluntary Manslaughter Elements
(1) Adequate provocation, (2) heat of passion, (3) no cooling time, (4) causal link between provocation and killing.
