Pro Roscio Amerino -- Chapter 17 and 18

ei erant veteres inimicitiae cum duobus Rosciis Amerinis, alterum quorum video sedere in accusatorum subsellis,

He had longstanding hostility with two Roscii from Ameria, one of whom I see sitting on the accusers’ benches,

alterum audio possidere tria huiusce praedia; si tam potuisset cavere quas inimicitias quam [bene] solebat mutuere, viveret.

the other I hear possesses three of this man’s estates; if he had been as able to guard against that hostility as well as he was used to fearing it, he would be alive [now].

que enim, iudices, ne metuebat iniuria. nam sunt duo isti T. Roscii, alteri quorum est cognomen Capitoni,

And indeed, judges, he was not afraid with[out] reason. For there are two of those Roscii, one of whom has the family name Capito,

iste qui adest vocatur Magnus, homines eius modi: alter habetur vetus ac nobilis gladiator, plurimarum palmarum,

[and] that one who is present is called Magnus — men of the [following] type: One is regarded as a seasoned and renowned gladiator, with many prizes,

autem hic nuper contulit se ad eum lanistam, que qui esset tiro ante hanc pugnam, quod sciam,

however this [Magnus] has recently attached himself to that trainer of gladiators, and he who was a novice before this contest, as far as I know,

facile superavit magistrum ipsum scerele que audacia.

easily surpassed the expert himself in wickedness and audacity.

nam cum hic Sex. Roscius esset Ameriae, autem iste Roscius Romae,

For when this Sextus Roscius was at Ameria, but that Titus Roscius [was] at Rome,

cum hic filius esset adsiduus in praediis, que cum, patris voluntate, dedisset se familiari rei que rustica vitae,

when this son was busy on the estates, and when, by his father’s will, he had devoted himself to the family business and to country life,

autem iste esset frequens Romae, Sex. Roscius occiditur ad Pallacinas balneas rediens a cena,

but that [man] was constantly in Rome, Sextus Roscius was killed near the Palatine baths [as he was] returning from dinner.

spero ex hoc ipso non esse obscurum ad quem suspicio malefici pertineat, verum id quod est adhuc suspiciosum,

I hope [that] from this very [fact] it is not obscure to whom the suspicion of the crime belongs, but [as to] that which is for now [only] a suspicion,

si res ipsa ni facerit perspicum, iudicatote hunc adfinem culpae.

if the case itself will not have made [it] clear, judge this [man as] implicated in the blame.
