Definition: Congressional oversight

refers to congress’ ability to monitor, scrutinise and restrain the president and the wider executive branch.

Although not explicitly stated in the constitution it has developed as an implied power essential to maintaining the separation of powers and control of public finances.

Theme 1

Congressional Committee

3
New cards

Congressional committee

Provide primary forum through which congress can question senior officials examine evidence and develop specialist expertise.

4
New cards

Committee also possess significant formal powers

issuing subpoenas, compelling sworn testimony and holding individuals in contempt of congress, which enable them to hold senior executive figures publicly accountable.

5
New cards

Obama administration, Secretary of state Hillary Clinton was subjected to sustained scrutiny by

House committees following the 2012 Benghazi attacks.

6
New cards

Post 2018 Midterm election which produced divided gov, House committees such as the

House Oversight and Reform committee and the House intelligence committee conducted regular investigations into executive conduct, focusing on issues such as compliance with congressional subpoenas, use of executive privilege and potential conflicts of interest linked to Trump’s business dealings.

7
New cards

committee oversight is not consistently effective

impact is often limited by partisanship and by the executive’s ability to resist enforcement.

8
New cards

During Trump’s first term, the administration repeatedly refused to comply with congressional subpoenas, including

blocking testimony from former white house counsel Don McGahn on the Mueller's case (investigation into Russia’s influence on 2016 presidential election).

9
New cards

Though the house judiciary committee voted to hold McGahn in contempt in 2019

enforcement relied on Department of Justice, which declined to act under democrat-led committee.

Theme 2

Impeachment

12
New cards

Power of impeachment

allow HoR to bring charges against senior officials and Senate to conduct trials, ensuring that no individual is above the law.

13
New cards

How impeachment works

process only requiring simple majority in House and two third majority in Senate, reflecting founder’s intention to balance accountability with political stability.

14
New cards

effectiveness of impeachment is most clearly demonstrated:

Richard nixon’s resignation in 1974 when the likelihood of impeachment and conviction forced president from office without a formal vote.

15
New cards

Impeachment has also been effective in the judicial branch, where party loyalty is weaker.

15 federal judges have been impeached with 8 being removed from office, including judge Thomas Porteous in 2010 whose unanimous conviction highlight impeachment's effectiveness when misconduct is clear

16
New cards

Impeachment of bill Clinton and Donald trump

conducted largely along party lines, with senators voting according to partisan loyalty rather than evidence-both failing in the Senate.

17
New cards

Trump’s second impeachment

2021 illustrated this problem clearly; though majority of senators voted to convict, the required two third majority was not reached.

Theme 3

Political circumstances

20
New cards

Under divided gov, oversight often becomes more intensive.

Obama administration faced sustained scrutiny from Republican controlled committees over the Benghazi attacks, including multiple investigations and extensive reporting.

21
New cards

early years of George W Bush’s presidency,

united republican control of congress resulted in limited scrutiny of the administration's claims regarding weapons of mass destruction in Iraq.
