What is the Criminal Justice process?
it’s when someone who commits a crime goes through the prosecution and conviction to release from prison
Fourth amendment
Unreasonable government searches and seizures
search warrant
An order signed by a judge describing a specific place to be searched
Probable clause
When it’s reasonable to think someone or a group of ppl are linked to a crime
Situations you can go in without a search warrant
When the police’s safety is at risk
5th amendment
Self incrimination
Miranda rights
right to remain silent and the right to having an attorney
Presumption of innocence
Innocent until proven guilty
6th amendment
Ensures the right to an attorney
What protects indigent defendants
From suffering extreme poverty
Speedy and public trials
The person has a right to an attorney right away rather than sitting in jail for a long time till someone looks at their case
Confirmation witnesses
Ppl accused of crimes have the right to confront the witnesses against them and ask questions. defendants get to do the same thing
Freedom from self incrimination
Cannot be forced to testify against yourself in a criminal trial
Ex post facto clause
Prevents the gov from punishing someone for doing something that was not a crime when the act was committed
8th amendment
Prohibits cruel and unusual punishment
Three strike laws
Laws that typically impose an automatic sentence of 25 yrs of life improves when a person is convicted
Capital punishment
Sentenced to death
Double jeopardy
A second trial for a person or punishment for the same offense
Habeas corpus
People who are imprisoned to challenge their confinement
