If jurors were motivated to use the cognitve mode, the bias towards using the experiential system did not operate
Liberation Hypothesis
When evidence favors a certain side in a trial, jurors will choose to favor the side with stronger evidence
But, if the evidence is equal, then jurors will decide to use assumptions and biases to determine which side to favor
Extralegal Information
irrelevant information to which jurors are exposed to during a case (propensity evidence, publicity or social media information)
Juror Bias
“a predisposition to interpret and understand information based on past experience”
it is inevitable
