Customs Act, 2082 (2025)
An Act made to amend and consolidate the law relating to customs to facilitate and secure international trade and increase efficiency in revenue collection.
Declaration
The act of providing details of goods to be exported or imported by the declarant in a form or transmitting them through electronic media before a Customs Officer.
Declarant
The owner of the goods to be exported or imported as specified in the declaration form, or the customs agent appointed by such owner.
Investigation Officer
An officer referred to in Section 77 who is designated to conduct investigation and inquiry regarding persons arrested or goods seized under the Act.
Import Smuggling
Importation of goods subject to customs duty without payment, clandestinely, through unauthorized routes, or without making a declaration despite not being subject to duty.
Clearance
The permission given by the Customs Officer to export, import, or remove any goods from the Customs Office pursuant to the Act and Rules.
Post-Clearance Audit
The audit of goods conducted after they have been cleared to ascertain if they match the declaration, value, and classification, or if duty facilities were used correctly.
Bonded Warehouse
A godown licensed by the Department to hold imported raw materials or subsidiary materials against a bank guarantee facility for export or specialized domestic sale.
Customs duty
Customs duty chargeable on goods to be exported or imported under the prevailing laws related to customs duty.
Customs value
The value of goods to be exported or imported determined in accordance with Chapter-4 for the purpose of determining customs duty.
Customs Officer
A term including Chief Customs Administrator, Chief Customs Officer, Customs Officer, and other designated officials such as Customs Inspectors or authorized officials.
Identical Goods
Goods which are the same in all respects, including physical characteristics, quality, and reputation.
Similar Goods
Goods which, although not alike in all respects, have like characteristics and component materials enabling them to perform the same functions and be commercially interchangeable.
Under-invoicing
A situation where the value declared by the declarant is lower than the value determined by the customs officer in accordance with the Act.
Over-invoicing
A situation where the declarant declares the value of goods at a price higher than the actual payment made or to be made for the goods.
Prompt Clearance
A procedure for items such as live animals, fresh fruits, vegetables, medicines, and vaccines that require immediate processing as specified by the Department.
Authorized Business Person
A person listed by the Ministry based on three years of compliance, stable internal controls, and financial capacity, who receives simplified clearance facilities.
Duty-free shop
A licensed shop authorized to import, store, and sell goods with tax exemptions exclusively to persons or entities entitled to diplomatic privileges or duty facilities.
International Transshipment
The facility granted for taking goods to another country through the territory of Nepal, typically without duty being leviable.
Advance Ruling
A determination issued by the Director General upon application regarding the classification or origin of goods to be imported.
Administrative Review
An application submitted to the Director General by a person dissatisfied with an order regarding valuation, classification, or other decisions within thirty days.
Customs Agent
A licensed person who performs office-related work, exporting, or importing functions on behalf of the owner of the goods.
Barricade
Physical objects or structures like gates or barriers placed in the Customs Area to control and regulate the movement of passengers or vehicles.
National Single Window System
A system developed and implemented by the Government of Nepal to regulate international trade by integrating concerned export or import agencies.
Demurrage
The delay charge payable by the owner of goods to the Government of Nepal when goods stored within customs premises are not cleared within the prescribed legal period.
