Crown Court Appeal
The first route of appeal for the defence from the Magistrates’ Court to the Crown Court, where the defence can appeal the conviction or sentence with leave from the Crown Court.
Kings Bench Division (KBD) Appeal
The second route of appeal for the defence from the Magistrates or Crown Court to the KBD, known as a case stated appeal, where the KBD can confirm, vary, or reverse decisions made in lower courts.
Supreme Court Appeal
The third and fifth route of appeal for the defence, where an appeal can be made only on important points of law, requiring leave, and the Supreme Court has the authority to change the law to settle the case.
Court of Appeal
The fourth route of appeal for the defence from the Crown Court, where the Court of Appeal can vary, quash, or dismiss convictions, and may order a retrial based on compelling new evidence with a 30% success rate.
