Dealer

Means any person who is licenced in terms of this act to trade firearms and ammunition

Designated firearms officer

means a official contemplated in section 124(2)(h)

1. any fully automatic firearm

2. Any gun, cannon, mortar or launcher manufactured to fire a rocket, grenade, bomb or explosive

3. Any frame, body or barrel of such a fully automatic firearm, gun, cannon, recoilles gun, mortar, light mortar or launcher

4. NAy projectile or rocket manufactured to be discharged from a cannon, recoilles gun, mortar, light mortar or launcher

5. any imitation of the weapons mentioned above.

5 devices that are NOT regarded as firearms

1. Any antique firearm

2. An air gun

3. A tranquilizer gun

4. a paintball gun

5. a flare gun

Where a person has not previously obtained a competency certificate. a competency certificate may only be issued to such a person if he or she:

1. Is 21 years or older on the day the application is recieved by the designated firearms officer

2. Is a south african citizen or a holder of a permanent South african citizen permit

3. Is of stable mental condition and not inclined to violence

4. Is not dependant on any substance which has an intoxicating or narcotic effect

5. has not been convicted, whether in or outside South Africa, of an offence involving violence or sexual abuse, whether committed in or outside South Africa, and sentenced to a period of imprisonment without the option of a fine, or physical or sexual abuse which occurred within a domestic relationship, as the fine.

1. Shotgun, which is not fully or semi-automatic

4. No person may hold more than one licence issued in terms of the section.

holder of a licence may allow another person to use their firearm.

As long as the licence holder is at least 21 years of age and hold a valid licence to possess a firearm issued in terms of this Act, any other person may use the firearm or be under his or her immediate supervision where it is safe to use the firearm for a lawful purpose.

renewal of firearm licences.

1. At least 90 days' notice before the date of expiry of the licence to apply for renewal.

2. A licence holder must notify the register of any change in his or her physical address within 30 days of such change occurring.

3. the holder of the licence must notify the registrar in writing within 30 days if there is any change with regard to any information which was submitted in respect of the applicant for the issue of that licence.

period of validility of lisence or permit (easy)

1. Licence to possess from self-defence: 5 years.

2. Licence to possess restricted firearm for self-defence: 2 years.

3. Licence to possess firearm for occasional hunting and sport shooting: 10 years.

4. Licence to possess firearm for dedicated hunting and dedicated sport shooting: 10 years.

5. Licence to possess firearm in private collection: 10 years.Permit to possess ammunition in private collection? 10 years.

6. Licence to possess firearm and permit to possess ammunition in public collection? 10 years.

7. Licence to possess firearm for business purposes? Business in hunting? 5 years.

8. Licence to possess firearm for business purposes? 5 years.

lost her studying licences.

If a licence is stolen the registrar must be notified within 24 hours.

The licence is stolen. The licence holder must apply for a copy of the licence. Within seven days of the stolen licence

carrying a farm in public.

1. Handgun must be in a holster or in a holder made for carrying a handgun attached to his or her person or in a rucksack or similar holder or in a holder designed for carrying the firearm.

restrictions on possession of ammunition

The holder of a licence to possess a firearm may not possess more than 200 cartridges for each firearm in respect of which he or she holds a licence unless they are a dedicated hunter or dedicated sports person and have a licence for this.

Declaration by a court of law that a person is unfit to possess a firearm.

1. Any offence involving the abuse of alcohol or drugs.

2. The unlawful possession of a firearm or ammunition.

3. An offence regarding the failure to store firearms or ammunition in accordance with the requirements of this Act.

4. An offence involving the handling of a firearm or being under the influence of any substance that has an intoxicating or narcotic effect.

5. A new offence involving violent sexual abuse or dishonesty.

presumption of possession of a firearm or ammunition

1. In control of such premises.

2. Over the age of 16 years and resident of such premises.

3. Where it proved that the firearm ammunition was found buried on land used for residential purposes, and the person at that time:

4. In control of such land, employed to work on the land where the firearm/ammo found, or over the age of sixteen years, and resident at such land.
