Criminal Law
A branch of municipal law that defines crimes, treats of their nature, and provides for their punishment.
Bill of Attainder
Legislative act which inflicts punishment without trial.
Crime
Acts or omissions punishable by law.
Classical Theory
States that man is essentially a moral creature with absolute free will to choose between good and evil, focusing more on the result of the felonious act than the criminal.
Positivist Theory
States that man is occasionally subdued by a phenomenon conditioning him to do wrong against his volition.
Utilitarian/Protective Theory
Emphasizes the mala prohibita principle, punishing offenses regardless of malice or criminal intent.
Eclectic or Mixed Philosophy
Combines positivist and classical thinking.
Equipoise Rule
Suggests favoring the accused when prosecution and defense evidence are equally balanced, in line with the presumption of innocence.

Any act or omission punishable under Article 3, RPC.

Acts punishable under special laws.

Inflicting physical harm resulting in distress on a woman or her child.
