First Amendment
Protects five fundamental rights: Freedom of speech, religion, press, assembly, and petition.
Types of Speech
Categorized into three types: protected, unprotected, and commercial.
Unprotected Speech
Speech that can be criminalized and may lead to prosecution or civil lawsuits.
Political Speech
Most protected form of speech focused on governmental or political processes.
Commercial Speech
Speech that promotes financial interests, such as advertising, granted less protection than political speech.
Symbolic Speech
Non-verbal expression that is protected if intended to communicate a message.
Content Restriction
Limits on speech based on its content, generally viewed unfavorably by the courts.
Time, Place, and Manner Restrictions
Regulations on when, where, and how speech can occur, permissible if content-neutral.
Strict Scrutiny Standard
A high standard of judicial review requiring a compelling governmental interest to justify restrictions on speech.
Intermediate Scrutiny
A lower standard than strict scrutiny for evaluating laws restricting commercial speech.
