What are the advantages of law making
Democratic process. Mp’s are elected by people and accountable to them, if don’t do as public wishes. E.g. 2010, Liberal Democrat’s promised to lower tuition fees at uni- when raised them, they lost votes at next election
Reform full area of law. Some areas cover wide topics and many different elements, parliamentary law making process allows areas to be changed. Seen with criminal justice act 2003, affected various different parts of criminal law.
Consultation on changes. Both Green paper stage and during the committee stage there is consultation with experts and interested parties. E.g. Green paper on children’s mental health in 2007, attracted feedback from schools, parents and medical professionals.
Allows detail to be added later. To make laws future proof, important to make sure minor details can be amended later without needing to repeat whole process, can happen through delegated legislation. E.g. dangerous dogs act 1991, allows more breeds fo be added to banned list if necessary.
What are the disadvantages of law making?
Long process. Due to different stages and the requirements for both houses to agree, some law, issue is no longer an issue. Almost some legislation can be fast-tracked, e.g. corona virus 2020- makes the law flawed and rushed.
Lack of time. Despite being a long process to change laws, some states are given limited times and sometimes debates are cut short when more time is needed. E.g. pressing matters like Brexit or corona virus, less urgent bills have debates cut short.
Gov control. Too much control over which laws are introduced and timetabling about when they can be debated, means some areas go ignored. E.g. current labour gov are prioritising certain policies such as housing, changing employment law rules- means issues other parties prioritise are not such a priority.
Complexity. Some areas are complex and need more involvement from experts on those areas. E.g. complex tax laws or medical laws, Mp’s and peers may not be knowledgeable enough to make these laws.
