Special Agency
An agent hired for a single, specific, and limited purpose
Example: A real estate agent who is hired to list and sell a client’s home
Express Agency
Established through explicit, clear communication, either written (listing agreement) or oral, where the principal and agent state their intentions
Example: A principal gives an agent a written document explicitly authorizing them to sell al specific property.
General Agency
A relationship where an agent has broad authority to act on behalf of the principal in a range of matters related to a specific business or trade.
Example: A property manager who has the authority to handle all aspects of a principal's rental properties.
Universal Agency
The most extensive type of agency, where an agent has authority to act on behalf of the principal in all matters, handling "everything" for the principal.
In Illinois, a Written Power of Attorney is required.
Example: An agent who is granted a universal power of attorney to make decisions on behalf of the principal in every aspect of their life and business.
Implied Agency
Not explicitly stated but is created by the actions of the principal and agent, can be unintentional, accidentally, or inadvertently. It includes authority that is reasonably necessary to carry out the express authority given.
Example: An agent who is explicitly authorized to sell a house might, through implied authority, also be able to list it on the multiple listing service without a separate, explicit instruction for that specific action
