Road Traffic Act 1988
Legislation governing road traffic offences and related duties regarding driver identification.
Section 172(3)
Requires the keeper of a vehicle to provide information about the driver's identity when required by a chief officer of police.
Section 172(4)
Defence against conviction under Section 172(3) if the person did not know or could not ascertain the driver's identity.
Section 172(7)
Allows a defence against conviction if the required information was provided as soon as reasonably practicable after 28 days.
Notice of Intended Prosecution (NIP)
Notice that must be served to warn a defendant of potential prosecution for road traffic offences.
Defendant's Warning
A requirement for certain offences to be warned about possible prosecution, given verbally or in writing.
Road Traffic Offences
Traffic violations including dangerous driving, speeding, and driving without due care and attention.
RTC
Road Traffic Collision, after which a Notice of Intended Prosecution is not required for certain offences.
