FR 56 Voluntary Retirement (Groups A and B - Condition 1)
Groups A and B Officers who entered service before attaining the age of 35 years have the right to retire after attaining the age of 50 years by giving 3 months notice.
FR 56 Voluntary Retirement (Groups A and B - Condition 2)
Groups A and B Officers other than those entering before age 35 have the right to retire after attaining the age of 55 years by giving 3 months notice.
FR 56 Voluntary Retirement (Group C)
All Group C employees have the right to retire upon attaining the age of 55 years by giving 3 months notice to the Appointing Authority.
FR 56 Voluntary Retirement (Qualifying Service)
All employees have the right to retire after the completion of 30 years qualifying service by giving 3 months notice.
FR 56 Notice Exceptions
Retirement notice is effective on expiry without approval unless the official is under suspension, has been issued a charge-sheet, or has pending judicial proceedings for grave misconduct.
Rule 43 Voluntary Retirement
Employees have the option to retire after completion of 20 years qualifying service by giving 3 months notice, which requires acceptance by the Appointing Authority.
GID (1), Rule 43 (Extraordinary Leave)
If voluntary retirement is applied for while on extraordinary leave (other than mechanical grounds), the 3 months notice period need not be insisted upon and may be accepted immediately.
Withdrawal of Retirement Notice
A notice can be withdrawn with permission of the Appointing Authority not less than 15 days before the intended date of retirement.
Pension Commutation Notice Rule
The Appointing Authority may accept a notice of less than 3 months, but commutation of pension can only be applied for after the expiry of the normal 3 months notice period.
Section 47 of the PWD Act, 1955
Superior officers should explain the legal rights under this section to employees applying for voluntary retirement due to disability to help them decide whether to continue in service.
Section 20 (4) of RPWD Act, 2016
Provisions that allow a disabled Government servant to continue in service with the same pay scale and service benefits instead of taking voluntary retirement.
Premature Retirement
Retirement ordered by the Appointing Authority in public interest, distinct from compulsory retirement (penalty) or voluntary retirement, requiring 3 months notice or pay in lieu.
Premature Retirement (Condition A)
Applicable after attaining age 50 for Groups A and B Officers who entered service before the age of 35 years.
Premature Retirement (Condition B)
Applicable after attaining age 55 for Groups A and B Officers (not entering before age 35) and all Group C employees.
Premature Retirement (Condition C)
Applicable to all employees upon completion of 30 years qualifying service.
