Spam
Bulk, unsolicited (junk) e-mail that accounts for roughly 75 percent of all e-mails.
U.S. Safe Web Act
Allows the Federal Trade Commission (FTC) to cooperate and share information with foreign agencies in investigating and prosecuting spamming, spyware, and Internet fraud.
Domain Name
The series of letters and symbols used to identify a site operator on the Internet; an Internet 'address.'
Goodwill
The valuable reputation of a business viewed as an intangible asset.
Cybersquatting
Registering a domain name that is identical or confusingly similar to the trademark of another and then offering to sell that domain name back to the trademark owner.
Anti-cybersquatting Consumer Protection Act (ACPA)
Makes cybersquatting illegal when the domain name is identical or confusingly similar to the trademark and there is bad faith intent to profit from that trademark.
Typo Squatting
A form of cybersquatting that relies on mistakes made by Internet users when inputting addresses into web browsers.
Meta Tags
Key words used by Internet browsers to provide specific information about a web page, which can sometimes lead to trademark infringement.
Trademark Dilution
Occurs when a trademark is used without authorization in a way that diminishes the distinctive quality of the mark.
Digital Millennium Copyright Act (DMCA)
Establishes penalties for circumventing encryption software or other technological antipiracy protections and allows fair use for educational purposes.
File-Sharing (P2P)
The sharing of resources among multiple computers without a central server, often used for downloading files.
Cloud Computing
The delivery of on-demand services from third-party servers over a network, typically subscription-based.
Electronic Communications Privacy Act (ECPA)
Amended federal wiretapping law to cover electronic communications and prohibits intentional interception of such communications.
Stored Communications Act (SCA)
Part of the ECPA, prohibits unauthorized access to stored electronic communications.
Cyber Tort
A tort committed via the Internet, with online defamation being one of the most prevalent forms.
Communications Decency Act (CDA)
Provides a shield to Internet Service Providers (ISPs) to protect them from liability for third-party content.
Privacy Policy
Statement by Internet companies regarding the collection and use of personal data from users.
Cookies
Small files stored in a user's web browser to track browsing activities and online behaviors.
Reasonable Expectation of Privacy
The standard that determines if a person has a legitimate privacy claim based on their situation or context.
