What is the definition of ABH?
Any injury or hurt calculated to interfere with the health or comfort of the victim (Miller)
What must cause the ABH injury?
An assault or battery
Examples of ABH
Minor cuts, broken nose, psychiatric injury (Chan Fook), temporary loss of consciousness (T v DPP)
What is factual causation?
"But for" the defendant's actions would the victim have suffered the injury (Pagett)
What is legal causation?
The defendant's conduct must be more than a minimal factor in causing the consequence (Kimsey)
Intervening acts
There must be no intervening acts which break the chain of causation (Jordan)
What mens rea is needed for ABH?
The mens rea for the assault or battery is sufficient (Savage)
