Judiciary act of 1801/ Midnight Judicial Appointments/ Marbury vs Madison
Judiciary act 1801 created more circuit courts and many new positions
all positions were filled by federalist
Adams kept adding federalists to these positions even into last day of office
Later when Jefferson (prez) and Madison (secretary of state) take office and Madison sees the commissions (like the paper that says who got the jobs) and doesn’t give the people their rightfully owned jobs b/c they’re federalist
One of the rightful job owners Marbury decides to sue Madison for this
Marbury cited Judiciary act 1789 writs of mandamus (states federal court could order something to occur or someone to do something)
Chief Justice Marshall’s declares it as unconstitutional
Established judicial review
Why did Marbury sue Madison
Marbury sued Madison because he was denied his commission for a judicial position, which he believed he was entitled to due to the Judiciary Act of 1801. He sought a writ of mandamus to compel Madison to deliver the commission.
What did Marbury cite in the Marbury case?
Marbury cited the Judiciary Act of 1789, specifically the provision for writs of mandamus, which allowed federal courts to order officials to fulfill their duties.
What is Judicial review?
Judicial review is the power of the courts to examine the actions of the legislative and executive branches and determine whether those actions are constitutional. This principle was established by the Supreme Court in the case of Marbury v. Madison.
