Daiichi Dispute

Dispute surrounding Stryker
Hill-Rom argued that a skilled worker would lack the technical knowledge to implement CAN networks in hospital beds without additional guidance. They claimed the examiner failed to establish a clear standard for the PHOSITA's skill level.

The examiner found that a PHOSITA must understand advanced scientific and engineering principles because hospital beds are complex systems.
The examiner noted that skill is measured by technical capability rather than formal degrees or years of experience. Furthermore, the PHOSITA's knowledge extends to communication networks used in other fields outside hospital beds.
PTAB’s Reasoning of PHOSITA
Board agreed that the field was multidisciplinary, spanning both medical devices and network communications.
Literature Support: Technical publications confirmed that CAN networks were already actively implemented in medical devices.
Applying network communications to medical equipment was not a brand-new field. Therefore, the PHOSITA was not simply a medical device designer, but someone knowledgeable in network communication systems
Inventor qualifications help determine the PHOSITA standard, and lead inventor Steven Dixon held a degree in electrical engineering technology. Dixon's testimony confirmed his familiarity with implementing serial networks in hospital beds.
Key active workers in the field, including inventor Dixon and competitor engineer Michael Hayes, both held bachelor's degrees in electrical engineering. Based on this, the Board established that the hypothetical PHOSITA holds at least a bachelor's degree in electrical engineering.
Industry Worker Practices: Competitor engineer Michael Hayes used prior networking experience to develop hospital beds and regularly stayed informed through technical journals and industry groups. This demonstrated that active workers in this field actively drew from broader networking knowledge.
PTAB’s Final PHOSITA Defintion
The Board defined the PHOSITA as an electrical engineer with at least a bachelor's degree working across medical devices and communications. This person understood CAN networks and how to adapt them to medical equipment.
