Chapter 003 § 61

Restrictions

Do not furnish, sell, or keep with intent to sell, any alcoholic beverages

Do not manufacture, sell, barter, transport, import, export, deliver, prescribe, furnish, or possess any alcohol

Powdered Alcohol Products

Do not knowingly possess or sell a powdered alcohol product (i.e. added to water or food)

Chapter 017 § 501

Unlawful Sale of Alcoholic Beverages; Civil Actions for Damages

An injured person shall have a right of action against any licensee who caused in whole or in part the intoxication of said person by selling or furnishing alcoholic beverages….

• To a minor

• To a person after legal serving hours

An injured person may bring an action against any licensee who negligently furnishes alcoholic beverages to a person…

• Apparently under the influence of alcohol

• Who it would be reasonable to expect would be under the influence as a result of the number of alcoholic beverages served by the licensee

A licensee’s conduct is negligent if they know, or if a reasonable person in similar circumstances would know, that the individual being served is intoxicated

Chapter 021 § 656

Person 12 Years of Age or Older and Under 21 Years of Age Misrepresenting Age, Procuring, Possessing, or Consuming Alcoholic Beverages; Impaired Driving; Possession of Cannabis; Civil Violation

A person 12 years old or older and under 21 years old shall not…

• Falsely represent their age for the purpose of procuring or attempting to procure alcohol from any licensee, State liquor agency, or other person(s)

• Possess alcohol from the purpose of consumption by the person or other minors

• Knowingly and unlawfully possess one ounce or less of cannabis, or five grams or less of hashish, or two or fewer mature cannabis plants, or four or fewer immature cannabis plants

• Consume alcoholic beverages

• Operate, attempt to operate, or be in actual physical control on a highway of a vehicle when the person’s BAC is 0.02 or more

Sale or Furnishing to Minors; Enabling Consumption by Minors, Minors Causing Death or Serious Bodily Injury

Do not sell or furnish alcoholic beverages to a person under 21 or knowingly enable the consumption of alcoholic beverages by a person under 21

Do not consume cannabis in a public place unless specifically authorized by law

Do not sell or provide tobacco products, tobacco substitutes, or tobacco paraphernalia to anyone under the age of 21

A person under 21 shall not possess, purchase, or attempt to purchase tobacco products, tobacco substitutes, or tobacco paraphernalia

A person under 21 shall not misrepresent their age to purchase or attempt to purchase tobacco products, tobacco substitutes, or tobacco paraphernalia
