1st: 60 days 2nd: 180 days 3rd or sub: 1 year. First offense requires a $100 dollar fine, a new learner’s permit exam, and a Driver Attitudinal Retraining Course. The fine for a second offense is $250, and $500 for 3rd.

PERMIT conviction for negligent operation/injury from cell phone use

1st: 180 days 2nd and sub: 1 year. $500 fine, 2nd and sub require a new learner’s permit exam, SCARR

Cell phone use for drivers under 18

Prohibited

A teen may not operate a motor vehicle within the first six months after receiving the JOL while any person under 18 is in the vehicle (other than immediate family member), unless:

The teen is accompanied by a person who is at least 21 years old, has at least one year of driving experience, holds a valid driver’s license from MA or another state, and is occupying a seat beside the teen driver.

Criminal offenses
