LABOR CODE OF THE PHILIPPINES P.D. 442

Article 1 — Name of Decree

The decree is known as the Labor Code of the Philippines (P.D. No. 442).

Article 2 — Date of Effectivity

The Labor Code took effect six (6) months after its promulgation.

Article 3 — Declaration of Basic Policy

The State policy to protect labor, promote full employment, ensure equal work opportunities, regulate labor-employer relations, and guarantee worker rights.

Article 4 — Construction in Favor of Labor

All doubts in interpreting or implementing the Labor Code and its IRRs are resolved in favor of labor.

Article 5 — Rules and Regulations

DOLE and relevant agencies issue implementing rules, effective $15$ days after announcement in general circulation newspapers.

Article 6 — Applicability

Rights and benefits generally apply to both agricultural and non-agricultural workers unless specified otherwise.

Article 7 — Statement of Objectives

Focuses on land ownership reform and emancipating tenant-farmers from conditions of bondage.

Article 8 — Transfer of Lands to Tenant-Workers

Grants family-size farms of $5\text{ hectares}$ (unirrigated) or $3\text{ hectares}$ (irrigated), with a landowner retention limit of up to $7\text{ hectares}$.

Article 9 — Determination of Land Value

Land value is $2\frac{1}{2}$ times the average harvest of $3$ normal crop years, payable over $15$ years in $15$ equal annual amortizations at $6\%$ annual interest.

Article 10 — Conditions of Ownership

Tenant-farmers must become full-fledged members of a recognized farmers' cooperative to acquire land titles.

Article 11 — Implementing Agency

The Department of Agrarian Reform (DAR) is responsible for promulgating rules to implement Chapter II.
