Criteria for ending worker’s compensation

1. Medical cert runs out 

2. RTW/ recovered 

3. Medical tribunal determination 

4. Plateau of improvement → permanent impairment Ax 

5. Noncompliance to requirements of rehab 

Usually 2 years 

→ X satisfied → common law claim

→ compensation for damages from employer to have caused injury due to negligence

Worker’s compensation obligations ( employer )

1. Keep job open for 12 months 

2. Regular contact w/ worker + insurer customer advisor 

3. Identify + provide duties of suitable standard 

4. Monitor worker’s progress 

5. Provide a supportive environment

Worker’s compensation obligations ( worker )

1. Participate in treatment/ rehab + RTW programs 

→ damages may be reduced due to non-compliance 

→ notify insurer that worker X adhering to recommended rehab
