Jamie Cuthbert - Closing Statement

Intro

Good afternoon ladies and gentlemen of the jury, my name is Harry Clarke-Hawkins , and I am one of the prosecutors in this case. In my colleagues opening statement, she mentioned that we would call 3 witnesses to testify as to the defendants guilty.

Each witness testified as explained and we have established the following facts beyond any reasonable doubt:

  • That on the night in question Jamie Cuthbert and an unknown figure did meet and exchange an item from the wash bag in question (Jamie)

  • That during the search of his vehicle the accused did frantically begin to delete messages from their phone and that two of these in particular point to some kind of deal taking place

  • That £1000 in cash and 100 ecstasy like pills were found in the accused possession.

  • And that the pills were in fact MDMA and the accused’s DNA was found on the inside of the wash bag containing amongst other things the drugs

Taylor Brooks Overview

  • Begin with brief overview of the first witness

  • On the 1st of September at some time after 3pm, Taylor Brooks saw Jamie and an unknown figure hunched over a car boot

  • As she watched, one of the figures passed something from the boot of the car to the other

  • Just as she looked away one of the figures saw her

  • She recognised him as the accused, Jamie Cuthbert,

  • As she realised he jumped in his car and sped away, while the other ‘scarpered in the opposite direction

  • She believed the interaction was suspicious and that in the accused’s rush to get away he was speeding

  • But what we the prosecution find most interesting in this interaction, is the unknown substance passed from the wash bag between them

  • As we know, Jamie was heading home at the time of his arrest after meeting with clients

  • During the search, only 4 items were found in his possession; a large bag containing toiletries, an IPhone 13, £1000 cash and the pills

  • Meaning that there are three different possibilities for what happened to this mysterious item

    1. It could have been one the items found in Jamie’s possession:

It couldn’t have been the wash bag as TB stated that the item came from the wash bag

It probably wasn’t the phone either because as Jamie stated it was his phone, so why would It be in Bailey’s wash bag - unless he lied about that

Leaving only the cash and the drugs (claimed cash was his)- credibility loss

  1. Jamie was handing something to BR;

He didnt’t disclose this in his witness statement - Lied to police (shady)

PC Jordan Rodgers

  • On the 1st of September, PC Rodger’s and his partner PC Chen stopped the accused’s vehicle at 18.00 hrs and searched it.

  • During the search they found
