  3. local activities that in the aggregate substantially effect interstate commerce

Wickard v. Filburn

  • congress passed a law called agricultural adjustment act

    • part set a quota on how much wheat each farmer could grow

    • trying to regulate price of wheat

  • Filburn plants more than regulation and congress tries to fine him but he says he is not selling it across state and he just uses it for himself

  • Filburn does not win this case

Wickard rule: congress gains powers to regulate state powers
