WHAT IS CYBER?

    • Includes the influences and interactions in virtual environments.


CYBER CRIME

  • Definition: Cybercrime is identified as a crime where a computer is either the target of the crime or a tool facilitating the crime. Examples include:

    • Hacking

    • Phishing

    • Spamming

    • Child pornography

  • Function of Cybercriminals:

    • Use technology to gain unauthorized access to personal and business information.

    • Engage in exploitative or malicious online activities.


LEGAL FRAMEWORK IN THE PHILIPPINES

REPUBLIC ACT NO. 10175

  • Cybercrime Prevention Act of 2012

    • Date Approved: September 12, 2012

    • Purpose: To address legal issues relating to online interactions and activities over the internet.

REPUBLIC ACT NO. 10173

  • Data Privacy Act of 2012

    • Focuses on the protection of individual personal information.


COMMON FORMS OF CYBERCRIMES

COPYRIGHT INFRINGEMENT

  • Definition: The unauthorized use of copyrighted material, which constitutes violation, piracy, or theft of exclusive rights.

  • Associated Case:

    • Rogers vs. Koons: A legal case involving the use of copyrighted imagery.

PLAGIARISM

  • Definition: The act of using or closely imitating someone else's language and thoughts without authorization.

COMPUTER ADDICTION

  • Definition: Generally refers to excessive engagement in computer-based activities, notably gaming.

  • Context: Can occur both offline (e.g., console gaming) and online.


CRIMINAL ACTIVITIES INVOLVING COMPUTERS

HACKING

  • Definition: Unauthorized access to computer systems, servers, or information and communication systems.

  • Activities Under Hacking:

    • Interfering with the normal operation of computer systems.

    • Corrupting, altering, stealing, or destroying electronic data without consent.

Types of Cyber Attacks
  • Malware: Software intended to harm or exploit a computer system.

  • Phishing: A method of obtaining sensitive information under false pretenses.

  • Brute Force Attack: An attack method where attempts are made to guess passwords or encryption keys.

  • Denial of Service Attack: An attack aimed at disrupting the normal function of a targeted server, service, or network.

  • Man-in-the-Middle Attacks: A type of eavesdropping where the attacker intercepts communication between two parties.


DENIAL OF SERVICE (DOS) ATTACK

  • Description: An attack aimed to make a service unavailable to its users by overwhelming it with requests.

    • Illustration:

    • Participants: Attacker, Cyber Zombies (botnet), Target Server.

    • Describes how the attack is executed.


COMPUTER VIRUSES

  • Definition: Malicious software that attaches itself to clean files to spread to other files.

  • Consequences: Can result in the loss, corruption, alteration, or theft of data.

ILLEGAL ACCESS AND INTERCEPTION

  • Illegal Access: Gaining entry into systems without authorization.

  • Illegal Interception: Involves spying on data transmission, leading to privacy breaches.


LEGAL CONSEQUENCES

  • Penalties for Cybercrimes:

    • Cybercrime against critical infrastructure: Penalty of 12-20 years imprisonment (reclusion temporal).

    • General Cyber crimes: Imprisonment of 6 years to 12 years (prison mayor).


PHISHING AND SPAM

  • Description: Phishing involves attempts to acquire sensitive information, such as usernames and credit card details, usually for malicious reasons.

  • Penalties: Up to Php 200,000 fine or imprisonment under prison mayor.


DIGITAL FRAUD

  • Illegal Downloading: Obtaining files without rights from the internet.

  • Digital Piracy: The unauthorized copying and selling of media, software, etc.

  • Penalties: Range of Php 50,000 – 500,000 fine and/or imprisonment (prison mayor).


BULLYING ONLINE

  • Cyberbullying: Using electronic communication to bully, where messages are threatening or intimidating in nature.

  • Legal Reference: Governed by the Anti-Bullying Act of 2013 (RA 10627).


CYBERSEX

  • Definition: Engaging in lascivious exhibitions or activities using computer systems for favor or consideration.

  • Context: Discussions on legality concerning relationships engaging in such activities.

  • Penalties: Minimum of Php 200,000 and/or imprisonment (prison mayor).


CHILD PORNOGRAPHY

  • Definition: Defined as unlawful acts involving the exploitation of children through computer systems, covered under Republic Act No. 9775 (Anti-Child Pornography Act of 2009).

  • Penalties: 12-20 years imprisonment (reclusion temporal).


CYBER DEFAMATION

  • Definition: Unprivileged false statements harming the reputation of individuals or companies.

  • Penalties: Imprisonment of 6-12 years (prison mayor).
