Express powers 

For congress these are powers specified and spelled out in article 1 of the constitution

Power to coin money 

Raising armed forces

executive branch article 2 

And the supreme court in article 3

Also called the enumerated powers 


Implied powers 

Not spelled out 

The necessary and proper clause gives congress the power to make all laws necessary and proper for carrying out its expressed powers 

Congress exercises many implied powers such as 

Building an interstate highway system banning racial discrimination in public places

The necessary and proper clause is also known as the elastic clause allows their powers to stretch passed what is expressed 



Inherent powers

Every government has inherent powers 

These powers are not based on the constitution they develop overtime 

Regulating immigration laws 

Acquiring territory 

Reserve powers 

The 10th amendment reserves to the states all powers not given to the federal government 

Establishing schools regulating elections 

General welfare 

States and local governments use the wide scope of reserved powers to perform many of their daily actions
