Week #3 Review: Important AG Procedures
- Regular Sick and Home Confinement (AG 330-01): When a Uniformed Member of the Service (UMOS) reports regular sick, they are prohibited from leaving their residence or authorized location for the entire sick occurrence without permission from the Department Surgeon or Sick Desk Supervisor under specific conditions. These conditions include being designated as Chronic Absent Category A or B, being on modified assignment, dismissal probation, or suspension, or if the Department Surgeon deems home confinement necessary.
- Administrative Sick Authorization (AG 330-02): Administrative Sick is NOT authorized for injuries, Line of Duty (LOD) injuries/illnesses, dental problems, voluntary tour exchanges, stress-related or psychological conditions, or major illnesses. Critically, it is authorized for UMOS designated Chronic Absent - Category A, but NOT for Category B.
- Line of Duty (LOD) Notifications (AG 333-03): If a LOD injury occurs within the first 2 hours of a tour and the incident was not specifically witnessed, the Desk Officer (not the Patrol Supervisor) is responsible for notifying the Sick Desk Supervisor or Sick Desk.
- Witness Statements for Injuries (AG 330-03): The Investigating Supervisor must interview witnesses for LOD injuries. If the witness is a non-Department member, a "WITNESS STATEMENT - INJURY TO MEMBER OF THE DEPARTMENT" is used; if the witness is a Member of the Service (MOS), the LOD Injury Reporting System witness statement is utilized.
- Sick Report and Court Arraignments (AG 330-04): If a member reporting sick has a pending arraignment, the Desk Officer must immediately notify the Borough Court Section concerned (not the court directly).
- Chronic Sick Category A Definition (AG 330-05): A UMOS is designated Chronic Sick - Category A if they report sick for any reason (excluding initial LOD absence or hospitalization) 4 or more times within a 12-month period.
- Major Incidents and Operations Unit (AG 330-07): The Desk Officer must notify the Operations Unit with details if a member is involved in a shooting, disaster, or violent occurrence resulting in death or injury.
- Animal Bites and Exposure Reports (AG 330-09): In the event of an animal bite, the MOS notifies the Desk Officer. The Desk Officer obtains an exposure report number via the LOD Injury Reporting System and records it in the Command Log. The MOS records it in their digital Activity Log.
- Counseling Services Unit (CSU) Scope (AG 330-16): The CSU provides assistance for alcohol, prescription medication, gambling, and financial difficulties.
- Discrimination and Sexual Harassment Notifications (AG 332-01): Non-supervisory members are strongly encouraged to notify the Office of Equal Employment Opportunity (OEEO). Supervisory members MUST notify the OEEO.
- Offensive Material (AG 332-02): Supervisors discovering offensive material must telephone the OEEO during business hours (0800 to 1800 hours, Monday through Friday). During non-business hours, they must leave a voicemail, photograph the material, and take immediate steps to secure/remove it.
- Prohibited Employment (AG 332-04): UMOS may not work as street peddlers or locksmiths within NYC, work for foreign governments, or have financial interests in arcades, video, or pinball games.
- Illegal Drug Use Suspicions (AG 332-06): Suspicions of illegal drug use by another MOS must be reported only to the Internal Affairs Bureau (IAB) Command Center.
- Retaliation Claims (AG 332-14): Victims of retaliation for EEO cooperation must follow AG 332-01 (notifying a supervisor, OEEO, or EEO Liaison), rather than the IAB.
- Vacation Retention upon Promotion (AG 324-01): Police Officers and Detectives retain original vacations upon transfer. Supervisory officers (e.g., a newly promoted Sergeant) may retain selections only if command efficiency is not impaired; minor adjustments are permitted to reflect new charts.
- Emergency Excusal Days (E-Day) (AG 324-05): Approval for an E-Day for the next scheduled tour must be granted by the Desk Officer on duty at the time of the request.
- Jury Duty Documentation (AG 324-07): MOS must provide court-issued Certificates of Service to the Integrity Control Officer (ICO), not the Commanding Officer.
- AWOL Procedures (AG 324-17):
- If AWOL for 2 hours at start of tour: The Desk Officer checks records, makes inquiries, and has a Supervisor (not just a Police Officer) from the member's resident precinct respond to the residence.
- If AWOL for 4 hours: The Desk Officer notifies the CO/Duty Captain, Borough Command/Counterpart, Operations Unit, and IAB Command Center.
- Performance Evaluations (AG 331-04, 331-09, 331-10):
- Total annual scores must correspond with the Overall Evaluation rating.
- OFFICER PROFILE REPORT: Submitted by MOS to Designated Supervisor by the 2nd day of the following month; delivered to Platoon Commander/Special Operations Lieutenant by the 5th day.
- Appeals: If a non-probationary member appeals, the Rater (not the member) informs the CO.
- Administrative Requests (AG 320-01, 320-02):
- Exchange of Tour: Requests must be submitted to the Operations Coordinator (not the CO) at least 5 days in advance.
- Inmate Visits (Off-duty): Typed Letterhead must be forwarded to the CO at least 7 days prior (not 5 days).
AG 318 Series: Discipline
- Orders of Protection (OOP) (AG 318-15):
- UMOS as Respondent: Must notify CO immediately. If command is closed, notify IAB CC (obtain log number) and the Operations Unit.
- CMOS as Respondent: Must notify their Commanding Officer/Supervisory Head immediately.
- MOS as Petitioner/Complainant: Must notify CO for safety reasons.
- Final OOP (Firearms Prohibited): UMOS has 2 months to seek a court modification for on-duty firearm possession. Failure to modify or seek modification leads to termination if the member has not left the Department.
- OOP Prohibiting Off-Duty Firearms Possession (AG 318-16):
- MOS may remain on full-duty if there is no basis for modified assignment but must safeguard firearms while off-duty.
- Items safeguarded: Service weapon, authorized off-duty weapon, "FULL DUTY" ID Card, and shield.
- Desk Officer/Supervisor must make a Command Log entry when items are taken or returned. Items other than the service weapon and authorized off-duty weapon are vouchered for safekeeping with specific PCI remarks.
- MOS receives a "NO FIREARMS" ID Card.
- Issuance of Command Disciplines (CD) (AG 318-02):
- Investigation: Conducted by a supervisor of higher rank. Desk Officer of the command where the violation occurred (Precinct of Occurrence) does not always assign the CD number; the CD number is assigned by the command where the subject member is assigned.
- Reporting: The original report goes to the subject member's CO. A copy goes to the issuing supervisor’s CO for their file/information.
- Election: MOS must notify CO in writing of their option (Accept finding/penalty, Accept finding/Appeal penalty, or formal charges) within 3 working days of the decision.
- Sealing Records (AG 318-02):
- Schedule A: Removed/destroyed after 1 year (no subsequent violations).
- Schedule B: Removed/destroyed after 3 years (no subsequent B/C or formal charges). Additional Schedule A entries do not block the sealing of a Schedule B.
- Unsubstantiated CDs: Removed/destroyed on the anniversary date of entry.
- Schedule A vs. Schedule B (AG 318-01):
- Schedule A: Non-judicial, minor violations (e.g., absence from post). Penalty: up to 5 days vacation/accrual.
- Schedule B: Specific violations (SPAR DANO+++). Penalty: up to 10 days vacation/accrual.
- SPAR DANO+ Mnemonics for Schedule B:
- Shield (Loss of).
- Prisoner (Failure to safeguard).

- Mandatory Suspension (Sergeant or above, No Discretion): Defined by the acronym ASPOT/GDASS & 2 Arrests:
- AWOL for 5 consecutive tours.
- Submit (Refusing drug screen).
- Perform (Refusing duties at roll call/tour).

- Talk (Refusing questions per AG 318-11).
- Gambling/Drugs/After-hours/Social Clubs/Smoke Shops (Interest in/association with).
- 2 Arrests: (1) NYSPL "Crime"/analogous and (2) DWI (NYSVTL 1192 sub. 2-4−a).
- Discretionary Suspension/Modified Assignment (Captain or above - IC CUP+):
- Indicted.
- Charged with offense.
- Charges & Specifications (Serious).
- Unfit (Intoxication).
- Patronizing unlicensed premises (Alchol sale only).
- Serious misconduct acts.
- Suspension Procedures (AG 318-06, 318-07):
- UMOS Property: Must surrender all Dept property, including smartphone, tablet, BWC, radio, and all revolvers/pistols.
- Reporting (UMOS): Mon/Wed/Fri at 0900 to Resident Precinct (50th for upstate, 105th for Long Island; Captains report to resident Borough Command).
- Waiver: Agreement to Accept Service of Notice requires DAO (Department Advocate’s Office) approval.
- Desk Officer Resident Precinct: Delivers report to the Integrity Control Officer.
- CMOS Property: Surrender all property. ID and shield hand-delivered to Shield, ID and Uniformed Services Unit by next business day.
- Modified Assignment (AG 318-08):
- Only Captain or above can place a UMOS on modified assignment.
- MOS must report to Personnel Orders Division at 0900 the next business day.
- No firearms or shield authorized. "NO FIREARMS" ID issued.
- Intoxication (AG 318-10):
- Supervisor must direct member to remain at a Department Facility or Other Location pending CO/DC arrival.
- Supervisor prepares Supervisor’s Fitness For Duty Report and contacts Counseling Services Unit.
- Restoration of Firearms (AG 318-13):
- Sergeant or above can remove firearms for unfitness.
- Desk Officer notifies Medical Division - Sick Desk for Firearms Removal serial number.
- Restoration requires CO approval on Part B of report. MOS presents approved report to Shield, ID and Uniformed Services Unit and Property Clerk.
- Arrested MOS (AG 318-09):
- Criminal violation excludes parking and traffic infractions except leaving the scene and impaired driving.
- Notifications: Desk Officer makes entry in Telephone Record. If outside city, MOS must notify the Operations Unit.
- Follow-up: MOS must keep CO informed every 30 days.
- Integrity Monitoring File (IMF) (AG 318-28):
- Designated Off-Limits: misconduct related + illegal conditions. Prohibited on/off duty within command.
- Unlawful Locations: Illegal activities (Gambling/Drugs). Prohibited on/off duty citywide.
- Cooping Prone: History of interrupted patrol. Prohibited on-duty only.
- Civilian Complaints (AG 318-17):
- Investigating officer must contact complainant within Five days.
- Final report (Disposition and Penalty Report) prepared within 90 days.
- Recusal (AG 318-27):
- Familial vs. Personal relationships. MOS must notify the Commanding Officer or Executive Officer immediately.
PG 211 Series: Court
- Duties and Conduct (PG 211-01):
- Uniform required unless: RASCO (Restricted duty, Arraigning deferred/holdover, Sick, authorized by Commanding Officer, or Off-duty).
- Cap guidelines: 8-point cap worn outside, carried inside.
- Sign in: At Appearance Control Unit (ACU). Notify if off-duty or multi-tasking.
- Testimony: State full name, rank, shield, and command.
- Adjournments: Request day duty (2nd platoon) and inform if it hits a RDO.
- Department Attorney (PG 211-20):
- MOS presents facts to a Supervisory Officer. Supervisor determines if conferral is needed. Contact hours: 0700-2300 Mon-Fri.
- If contrary advice is received (from ADA or supervisor), the member must follow the Department Attorney’s advice and notify them of the conflict.
- Corporation Counsel (PG 211-21):
- Desk Officer accepts summons/complaint for member Assigned to the Command.
- Two Command Log entries: (1) date/time of service, (2) date/time of member receipt.
- Verification: Member contacts Legal Bureau ten business days after CO forwards the request.
- Notice of Claim: Improper if served to NYPD; direct process server to the Office of the Comptroller.
- Traffic Violations Bureau (TVB) (PG 211-10, 211-11):
- If summons is 10 years or older with no recollection, notify the Integrity Control Officer.
- MOS must have officer’s copy of summons AND Activity Log (digital printout).
- Extended Tours: 1st platoon reports at 0800; 3rd platoon reports at 1415 (business attire, no portal-to-portal).
- Training Sergeant: Monthly review of the ten UMOS with the Highest Percentage of Dismissals.
- Notifications (PG 211-05):
- Short Date: Received after roll call is closed for next day or Monday. Email sent to MOS, Roll Call, Ops Coordinator, and ICO.
- Conflicts: Notify the Appearance Control Unit (ACU) via Desk Officer to mediate.
- 4th Platoon: Subpoenaed members reassigned to 3rd platoon (1600 x 2400) to allow for next-day court. If dismiss at 2400, no overtime for 2400-0200.
- RDO Appearances (PG 211-07):
- Inform the Appearance Control Unit (ACU) supervisor of RDO conflict. ACU must sign digital Activity Log if date change is impossible.
- Tour starts at 0900 or as appropriate.
- Cancellations: Voicemails are insufficient; explicit concurrence from the requesting agency is required.
- Court Alert (PG 211-06):
- Criminal Court Alert: If not activated by 1300 hours, it is deactivated for that day.
- Civil Court Alert: Attorney details entered in Command Log.
