The Executive Branch

Sec. 1

The President is... 

  • Chief of State: The ceremonial head of the government of the US, the symbol of all the people in the nation.  

  • Chief Executive: They are vested by the Constitution with “the executive power” of the US. 

  • Chief Administrator: The director of the huge executive branch of the Federal Government.  

  • Chief Diplomat: The main architect of American foreign policy and the nation’s chief spokesperson to the rest of the world.  

  • Commander in Chief: Head of the armed forces. 

  • Chief legislator: The main architect of the nation’s public policies.  

  • Chief of Party: The acknowledged leader of the political party that controls the executive branch. 

  • Chief Citizen: The representative of all the people. 

All roles of the President serve a purpose and have an equal amount of importance.

However, I feel that either the role of Chief Diplomat or Chief Citizen is the most important because they regard the president’s image and moreover our country’s image. Handling foreign relations is complex and requires a leader who will lead America with dignity in different affairs. I feel that is the most important quality.

To run for President, you must:  

  • Be a “natural born” Citizen 

  • Be at least 35 years of age 

  • Have 14 years of residence within the US 

-The 22nd Amendment made the custom that would limit the president to only two terms.

Before that amendment's creation, American presidents would serve an unlimited number of terms.

  • It was only until FDR’s 4 consecutive terms that the 22nd amendment was thought of and added to the constitution.

Arguments for the two term limit

For: The two-term limit was necessary as it ensures that our leader is still very much a part of the democracy. It prevents individuals from running too long and potentially abusing their power (like becoming a dictator).

Against: The two-term limit can take away power from voters as voters’ choices are restricted when a candidate, they still support is not listed on the ballot.  

Sec. 2

The purpose of Presidential Succession is so that during the time of a presidential vacancy, that position is filled.

  • -If a President dies or resigns, or is removed from office by impeachment, the Vice President succeeds to the office.

The 25th Amendment in 1967 acknowledges the scheme of presidential succession.

  • Originally, the Constitution did not provide for the succession of the Vice president.

  • It declared that “the powers and duties” of the office (not the office itself) were to transfer to the Vice President. 

The Vice President is to become Acting President if: 

  • The President informs Congress, in writing, that they are unable to discharge the powers and duties of his office.  

  •  The Vice President and a majority of the members of the Cabinet inform Congress, in writing that the President is so incapacitated.  

Formal duties of the Vice-President include:

  • Presiding over the Senate. 

  • Help deciding the question of presidential disability.

The Election of 1800

Each of the 73 Democratic Republicans who won posts as electors voted for their party’s nominees: Jefferson and Aaron Burr.

  • Doing this produced a tie for the presidency.

  • Jefferson ended up being chosen as President by the House of Representatives after taking 36 separate ballots, while Aaron Burr was made Vice President.

The election of 1800 marked the introduction of three new elements into the process of selecting a President:

  • (1) Party nominations for the presidency and vice presidency

  • (2) The nomination of candidates for presidential electors pledged to vote for their party’s presidential ticket

  • (3) the automatic casting of the electoral votes in line with those pledges.

The 12th amendment would change the electoral college in that the presidential and vice-presidential elections would be separated.

  • The Electors would now name in their ballots the person voted for as President, and in distinct ballots the person voted for as Vice President.

An argument in support for the electoral college is that it creates cohesiveness of the country by requiring a distribution of support to a potential President.

An argument against the electoral college is that it creates the possibility for the loser of the popular vote to win the electoral vote.
