• Two main issues form the foundation of tort law discussions, corresponding to the two parties involved in a tort case:
    1. Plaintiff: The individual who has suffered damage.
    2. Defendant: The individual who is accused of causing that damage.

• A tort law case primarily investigates whether the defendant has an obligation to compensate the plaintiff for the damages incurred.

Conditions for Liability

• The first key issue addresses under what specific conditions the defendant can be rightfully held liable for the damage caused.
    - Fundamental questions include:
      - Why is the defendant the designated party responsible for compensating the plaintiff?
      - How does the defendant's behavior correlate with the type and extent of damage suffered by the plaintiff?

Types of Damages

• The second key issue concerns the types of damages for which the plaintiff may seek compensation.
    - Physical Injury: It is widely accepted that plaintiffs can claim compensation for physical injuries.
