Introduction to Intellectual Property (IP)
Definition: Intellectual Property (IP) refers to creations of the human intellect that are protected due to their commercial value. These creations are treated as property.
Examples: Inventions, scientific discoveries, industrial designs, literary and artistic works, and symbols used in commerce.
**Nature/Characteristics of IP:
*Creation of Human Mind:* IP is a product of human intellect.
Intangible Property: It exists in a non-physical form.
Exclusive Rights: Statutes grant exclusive rights to the creators.
Time-Bound: These rights are limited in duration.
Territorial/Jurisdictional: IP rights are valid only within specific geographic boundaries.
Intellectual Property Right (IPR) vs. IP
IPR is a right vested in the IP asset, but it is not the asset itself.
Example: An idea is IP, while a patent registration for that idea is an IPR.
A customer list is IP; the right to confidentiality regarding that list is an IPR.
Further Examples:
A secret production method is IP; the right to protect that secret is an IPR.
A particular way of representing something is IP; copyright or design registration for that representation is an IPR.
A brand name is IP; trademark registration for that brand is an IPR.

Trademark Definition (as per the Trade Marks Act 1999)
A mark capable of being represented graphically and which can distinguish goods/services of one person from those of others.
