Board Composition
members total: public, professional.
Governor appoints public + all professionals (cosmetologist, barber, esthetician, electrologist, manicurist, establishment owner).
Senate Rules Committee and Assembly Speaker each appoint public member.
Board Powers & Priorities
Make regulations, conduct exams, issue/discipline licenses, set sanitation rules.
Provide written materials in English, Korean, Spanish, Vietnamese.
Paramount mandate: protection of the public.
Inspections & Compliance
Executive officer/representatives may inspect any establishment, mobile unit, or school during business hours or when services occur.
Program of random & targeted inspections to monitor health, safety, and market conditions.
Health & Safety Advisory
Physical/Sexual Abuse Awareness: covers domestic violence, sexual assault, human trafficking, elder abuse.
Advisory Committee gives recommendations on health, safety, basic labor laws, and client abuse awareness.
Scope of Practice
Cosmetology = hair care (arranging to coloring), skin/scalp massage, nail services, lash/brow tinting/perm.
Excludes wig sale/fitting, threading, and electrolysis (hair removal via electric needle).
Hairstyling = non-chemical styling/maintenance of all hair textures.
Licensing Requirements & Restrictions
Unlawful to practice/operate for compensation without valid, unexpired license (except approved students/externs).
Licensees may perform only within their licensed categories.
Violations → administrative fine and possible misdemeanor.
Student exemption: services allowed within approved school.
Manicure/pedicure: only necessary metal tools permitted.
Cosmetology Exam Eligibility
Age ≥ ; completed th grade or equivalent.
Pathways: approved school course, out-of-state experience (each months practice = training hrs), barber license + crossover course, full barbering course + crossover, or approved apprenticeship.
Examination Process
Written exam focuses on consumer health/safety, practical knowledge, antisepsis/disinfection, equipment.
Application must include fee, proof of qualifications, signed labor-rights acknowledgment; present unexpired photo ID.
Pass → license issued same day; fail → receive total score.
Application abandoned after year of inactivity; new application required.
Establishments
“Establishment” = any site (incl. natural hair styling) where licensed services are offered.
License application must include labor-law acknowledgment; new location requires new license.
Barber pole usage without employing barbers = unfair business practice.
No residential use of service areas; must have separate entrance; violation is misdemeanor.
Facilities: at least public restroom, screened entrance, no storage in restroom; provide hand-washing amenities; maintain cleanliness, lighting, ventilation.
Mobile Units
“Mobile unit” = self-contained, enclosed, board-licensed vehicle for services.
License application: detailed floor plan, proof of purchase/lease, fee, driver’s license, permanent base address; board inspection required.
Must have potable water (for shampooing), hot water tank ≥ -gallon, adequate ventilation.
Residential use within unit prohibited.
