Executive Order 9066
Executive Order Overview
This executive order grants the Secretary of War the authority to establish military areas during wartime, as a measure to protect national defense against espionage and sabotage.
Authorization of Military Areas
The Secretary of War can prescribe specific military areas from which persons may be excluded.
Restrictions on entry, residency, or exit from these areas are at the discretion of the Secretary or designated Military Commanders.
Provisions for Excluded Residents
The order allows the Secretary to provide necessary accommodations (transportation, food, shelter) for those excluded from military areas until alternative arrangements are made.
Superseding Authority
Designation of military areas overrides previous prohibitions set by the Attorney General under proclamations from December 7 and 8, 1941.
The order further authorizes military enforcement, including Federal troops, to ensure compliance with area restrictions.
Assistance from Federal Agencies
All Executive Departments and Federal Agencies are directed to assist in the execution of this order by providing resources and support.
Clarification of Responsibilities
The order does not modify existing authorities granted under prior executive orders or those of the Federal Bureau of Investigation and the Department of Justice regarding investigations and regulations over alien enemies.
