Conditions for Initiating a Professional Conduct Review:
- Sufficient evidence indicating a possible breach of the Real Estate Act or Rules.
RECA's Philosophy Regarding Licensees:
- Licensees must know and follow the Real Estate Act and the Rules.
- Licensees must provide competent services.
- Licensees must stay updated on regulations and standards.
Voluntary Broker Resolution Process
Definition:
- A process for minor issues that do not require further action.
- Involves voluntary resolution between the broker and complainant.
Advisory Note:
- May include a recommendation to avoid future issues.
- Noted in the file.
Common Resolution Step for Minor Complaints:
- An apology to the complainant.
- Potentially followed by additional training or supervision.
Resolution Process for Serious Cases:
- The full range and level of disciplinary actions may be applied.
